Abstract
The present investigation was carried out with the initiative of highlighting the work of the forensic psychologist in sentencing cases of sexual crimes, by playing a fundamental role in the argumentation and support of the version of the facts given by the victim in a hearing, which is accepted by the judge when compiling the evidential facts of the commission of the crime, In this way, the characteristics of an expert's report are specified, as well as the due delivery of the expert's report by the psychologist, who presents in detail the victim's account of the facts, allowing the judge to have the greatest amount of information to contribute to the sentence and to make decisions in the case based on these arguments. The countries under study are Colombia and Mexico, since these countries are strongly affected by violence in all its dimensions. Three judgements were compiled from each country, and an analysis was made of the way in which the expert reports delivered to the judge are received, taking into account that any evidence presented to a judicial body must be duly supported technically and scientifically, Since decisions are made in this field that have to do with the lives of several people, and these can have consequences for what has happened, it is important to emphasize the importance of handling the personal data of individuals who are part of this entire judicial process, because the confidentiality of each person must be respected and so must each of their rights. The investigation makes clear the contribution that the area of forensic psychology makes to the legal area, as is evident here in the judgments on sexual crimes. This is a very important issue since it deals with decisions that have an impact on psychological elements such as the emotional ones and the consequences caused by the damage or offense to the psyches of children and adolescents.
